Two law enforcement sources, close to the investigation, said Chicago Police believe 'Empire' actor Jussie Smollett paid two men to orchestrate an assault on him last month. In fact, Smollett and his pals reportedly rehearsed the alleged attack.

The men, who are Nigerian, and brothers, were arrested but released without charges Friday after Chicago police cited the discovery of "new evidence."

Law enforcement sources tell TMZ that the case will go before a grand jury this week.  A panel will hear the case, but there was no word on who is facing charges — or what they might be.

At least one of the brothers turned over his phone and there is a call between him and Jussie in the vicinity of the "attack," but the call was before it happened.

A police source said the men had a previous affiliation with Smollett, but did not provide additional details. Some reports say both of the men appeared on “Empire.”

Smollett denies playing a role in his attack. His attorney said: ”One of these purported suspects was Jussie’s personal trainer who he hired to ready him physically for a music video. It is impossible to believe that this person could have played a role in the crime against Jussie or would falsely claim Jussie’s complicity."

Smollett says he was attacked early January 29 by two men who were "yelling out racial and homophobic slurs." One of them allegedly yelled "This is MAGA country.” He said one attacker put a rope around his neck and poured an unknown chemical substance on him.

Police said they did find a receipt for the rope that was found around Smollet’s neck in the home of one of the brothers.

The Nigerian brothers, according to members of the ”Empire" cast and crew, are very close to Jussie. On top of that, they’re pro-LGBTQ and anti-Trump too.

The brothers' lawyer says her clients were released based on the key info they gave the cops ... and they have a story to tell "when the time is right.”
